By downloading, installing, or using the Baby Genie application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the App.

2. Description of Service

Baby Genie is a baby planning companion application that provides:

  • Reveal Mode: Gender predictions for expectant parents based on user-provided data.
  • Plan Mode: Optimal conception date range suggestions based on user preferences and cycle data.

3. Entertainment and Informational Purposes

Baby Genie's predictions and recommendations are provided for entertainment and informational purposes only. The App is not a medical device and does not provide medical advice, diagnosis, or treatment. Our predictions are based on a proprietary algorithm and should not be relied upon as a substitute for professional medical guidance.

While our algorithm achieves over 87% accuracy based on historical data, individual results may vary. We do not guarantee the accuracy of any specific prediction.

4. User Accounts

To access certain features, you may be required to create an account. You are responsible for:

  • Providing accurate and complete information during registration.
  • Maintaining the security and confidentiality of your login credentials.
  • All activities that occur under your account.

You must be at least 18 years old to create an account and use the App.

5. User Data and Privacy

We collect and process personal data as described in our privacy practices. By using the App, you consent to the collection and use of your information as outlined. We are committed to protecting your privacy and will not sell your personal data to third parties.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. Baby Genie Inc. makes no guarantees that:

  • The App will be available at all times or without interruption.
  • Predictions or results will be accurate or reliable.
  • The App will be free of errors, bugs, or security vulnerabilities.

9. Limitation of Liability

To the fullest extent permitted by law, Baby Genie Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

  • Your use or inability to use the App.
  • Any predictions, recommendations, or content provided through the App.
  • Unauthorized access to your data or account.
  • Any decisions made based on the App's output.

10. Indemnification

You agree to indemnify and hold harmless Baby Genie Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the new Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, without prior notice. Upon termination, your right to use the App ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.
